Because sex work is (usually) something someone makes a conscious choice to do and is not a factor someone cannot control like race, religious beliefs, or sexuality, the defense that they’re being discriminated against doesn’t hold up too good in court. That means that even if you are the most wonderful, qualified person for the job, you can be refused a job or fired if someone finds out about your porny past.

It’s not that the law is saying that it’s okay for employers to treat you that way because you took it in the butt on camera … it’s just that no law exists to protect you against it.

It’s possible that if you had a good lawyer and a certain situation, you could fight the employer for discrimination, but if you won, I’d be pleasantly surprised.

Making matters even poopier, an employee who fails to disclose their XXX past on his or her résumé would be compromised further; the employer could argue that the employee had been hired under false pretenses, leading the court to side in their favor.

So what are performers supposed to do then? Do they tell the employer and hope they’re not discriminated against, or do they keep it a secret and hope no one finds out, knowing that if someone does, their ass is grass? The short chode of an answer is … fuck if I know.

It sucks that there’s so much legal discrimination against porn performers out there today that it's become a commonplace occurrence. I’d love to live in a society where people gave less of a shit about some dumb film you made 10 years ago (that said bigots in society probably jacked off to with a necktie-noose around their jugular in the dark). But the reality is, porn is compromising. Some employers can’t handle that factoid. I don’t like it anymore than you do, but until someone pushes anti-discrimination legislation for sex workers or until society calms down from their porn terror, I’d say just live your life as best as you can and fuck what people think of you. (Not on camera though. We talked about this.) It’s not going to be easy to go unrecognized, but you’ll be okay. Stay away from jobs that involve children unless you love getting fired amongst a media scandal and a series of spin-off porns about you, a la Sydney Leathers.

May I suggest a job in the magazine/editorial world? We never look at porn … more than once an hour.
